Help: Why are my servers always down?

Alright so I bought 2k13 for xbox about a week ago and for some reason everytime I get on the game it automatically tells me the 2kSports servers are temporarily down. I can't use any of the online features even though I am signed in on xbl. What's interesting is that I also have 2k13 on the ps3 and it works fine but not on the xbox. If anyone has any idea on how to fix this please let me know, any help is appreciated.

I don't have live membership so I don't think it's that.

Alright so I contacted 2k Support and the issue was I had the same 2k account for both ps3 and xbox , now I'm waiting on them to delete my current 2k account so I can make a new one and connect it to my xbox.

So you know you need Xbox Live Gold?

I mean, if you still don't think you need it, you're wrong. You've been told by LD2k himself that you need Live. I would be disappointed if you ignored what has been said and you deleted your 2K account.
