most likely it's in the MLB contract that is must ship by a specified date. Also, coming out later than the competition can have a huge affect on sales.

Coming out with an unfinished, untested game would have a greater negative impact on sales, IMO. Besides, those hundreds of thousands of 360 owners have no choice. If they have to wait, they have to wait.
