New or old patch

When online with the Xbox, does the patch download automatically, or is there somewhere in the menus for that? It could be the new patch or old, for all I care. The game I have is out of the box and I've read on here there are several things that since have been adjusted and changed.

If you don't have the patch downloaded, as soon as it signs into live it'll pop up a box saying there is a update available for the game. And if you don't update, it'll sign you out of live.

Thanks. It doesn't say anything when loading up, but I guess it could have. I updated the rosters and that took awhile. Is there a way I can see if the patch is on or not?

As of this morning the patch was not out on 360 yet.

When it is, it will download automatically as long as you are in Live and put in the NHL 09 disk.
