Former QB suing EA over name usage

Sam Keller is seeking a class action lawsuit against the NCAA and EA Sports for creating visual representations and allowing name usage that "exploits" college athletes represented (or not) in the popular NCAA Football and Basketball games made by EA Sports.

If you're an NCAA fan like me, you better hope he doesn't win. This could mess up college sports games.

He claims he's not after the money, but there must be some hidden agenda or deep rooted anger toward someone. This would really throw a cog in the gears of roster editing for NCAA Football video games.

Keller is a tool.

He's suing because he was simulated in a visual representation? Does he posses a distinct likeness that was harmed by a close but not exact usage in this game?

EA pays NCAA a big fee for the right to do what they do. I think the NCAA is more on the hook here. If the court rules in favour of the players, part of the license should be given back to the players in trust somehow.

EA should create a PC based roster editor and allow people to create rosters using real pictures off the net if we want. That could be a work around if this suit is successful.

If he played as well as his video game likeness from 07 he would have been drafted instead of a freshman taking his spot. If his throwing power and accuracy would have been 85 and 75, that would have been his video game likeness and he could sue, lol.

Almost immediately the NCAA is off the hook in this case, which shows just how much of a reach it is. Keller and Co. aren't even sure who to sue. I'm still a tad bit nervous until it clears but I'm sure EA will find their way out of it.

even if ea cant find a way around it; i'm sure it will be settled out-of-court

Let's hope so. Or at least hope that it isn't settled before the game is released this fall.
