Is there a way to download the patch without xbox live?

I don't understand your question? If your going to download something already why not just hook your Xbox up to the Internet?

The answer is yes. You would need to get it from somebody who uploads it that has already received the update and place it on you Hard Drive or run it off a USB flash drive.
