I wouldn't be shocked if he's in the game, even though he hasn't fought. He's under contract and could move a couple copies.

With all of these fighters I may even give career mode a try. Fighting low and mid level UFC guys will be much better than fighting fake guys. I haven't played career mode in a UFC game since the second THQ game and I can't remember... do they have some sort of regression/progression set up where older fighters regress and eventually retire and younger guys get better?

Punk may not have fought yet, but he's been under contract for over a year, so I expect he'll be in the game.
