For the record I was in contact with tech support every day until I got my e-mail stating the refund was denied. I'm pretty sure if the game comes out before 12am tonight you won't be getting one.

I really dont need a refund, i just wanted to go digital so put the money on my account. So i will wait, im okay waiting. I gotta go to work, and then a quick download then some show goodness.

Yup they wanted them pre orders they know what the end of the day will wait to play so they knew about it and they never said anything that's what's frustrating

This has been one pathetic experience. I will never buy digital on my consoles again, Steam has never been this bad. Absolutely unacceptable it still is not ready.
