MLB Front Office Manager Giveaway: Question #5 (Double Points) Stuck

Looks like Goallout13 is getting closer to winning with another point earned this past question. That puts him at 3 with a slew of guys at 1 point and kwrichardson at 2 points. Here is the full breakdown:

So with that, question #5 will be given to just one person...the first person to answer the situation correctly. The person to answer this question will earn 2 points in the contest. We have just two questions left, so getting this one will put you right in the thick of things. In my opinion, this is probably the easiest question thus far if you have some common GM knowledge. Unlike past scenarios, I am using real players in this one but with a completely fictional scenario. Here is the question:

The recession has hit the Boston Red Sox especially hard in this scenario. They are unloading players at a fever pitch through trades in order to shrink the payroll. The Red Sox are set to trade David Ortiz to the Washington Nationals for a couple of prospects. Ortiz does not like the idea of it and is not going to give you the go ahead even though his contract does not include a no-trade clause. As the GM, can you go ahead and make the trade or are you in trouble here? Why or why not?

As a GM yea you could trade the player if he has a no trad clause in his contract. As long as he passes a physical and the Nats are willing to take on his contract. The only option ortiz has is to threaten to sit out, but then a grievance could be filed with the players union and his contract could be terminated. As long as he as a no trade clause and he passes a physical and his salary is taken care of either entirely by the nats or partially by the sox the GM can trade him in this situation.

in my first sentence I meant to say "As a GM yeah you could trade the player if he doesn't have a "no trade" clause." In my rush to post first I didn't re-read it.

Simply put, Ortiz has 10yrs MLB service, 5yrs with the same team. As such he can veto any trade, w/o having a no-trade clause in his current contract. All 10 & 5 players are afforded this provision.

I should add that the rule is refered to as the 5/10 rule. And the 5 yrs has to be with his current club, obviously.

Damn class, wasn't here on time to get the question but I think Blaise has it, Ortiz can not be traded without him approving it. However upon reading the CBA of the MLBPA, I am a little unsure of whether they can or not, it all depends on what David Ortiz's contract states. Since his contract was signed in 06, before his 10 years of service, if he gave the Red Sox at the time of the signing the right to waive the 5/10 rule until after he resigned his contract when he was at his 10 years experience, then that would provide them the right to trade him still. Maybe I am just getting myself mistaken on the CBA with how they worded it, but there is a lot of fine print I'm sure on these contracts they sign. However for the basis of this, I assume that Ortiz has the oppurtunity to decline it, therefore Blaise has it exactly correct. So the Red Sox can not make the trade without getting consent from Ortiz.

Took me forever to post on my cell. Goalout, I don't think a player can waive his 5/10 provision. I'd have to look in cba, but i believe it is a right given to every MLBPA member who is eligible.

Oh and Section A(1) is simply stating the 5/10 Rule

I wonder what their definition of "assignment" is? Whether their talking about a trade, or assignment to the minors...

Oh yeah, sorry, these things are so confusing to read, but here, I will post the whole part on this 5/10 Rule.

Sounds like its all there...I just wonder what player would, in their right mind would waive their 5/10 right just for an extension...

Yep, Blaise nailed it! Congrats man...you are now right in the thick of things. The final two questions will be posted tomorrow. The first is for 2 points and the last one will be worth 3....I have a few different things I could pick from so I'm still debating what the format will be.
