In my mind, you cannot let a sex offender like that ever go free. I don't believe they can be rehabilitated. My wife has an uncle who is old and in terrible health (wheel chair bound), yet he still managed to molest kids again when given the chance. This is a guy who molested one of my wife's sisters when she was a kid. That sister is a total disaster these days due to drug use and poor choices, and a large part of it has to be attributed to what happened when she was a child. The devastation these people leave is beyond estimation. Her life has been ruined, and she continually makes mistakes that are ruining the lives of her own kids (who she never should have had). Sex offenders simply need to be separated from society forever. Last edited by Kodos : 10-28-2015 at 11:23 AM. |

Gross. I'm watching Dr. Phil. They are interviewing the woman who was investigating Fogel. It is nasty. The woman is telling him about kids she is inviting to a party. 7,8,10 years old. And he is loving it.
He talks about young girls and going to Thailand with the woman. And her being with young boys while he is with young girls. He is getting excited. Dr. Phil is comparing it to phone sex. What a nasty, nasty man.

Meanwhile in Minnesota, they might have found the man behind the disappearance of Jacob Wetterling, an 11 year old boy who has been missing since 1989. He was arrested on child pornography charges, not for the disappearance, but he molested another boy around the same time who survived and gave a sketch-that looks very similar to a photo of the man today,

He'll get a maximum of about 50 days off of the sentence per year for good behavior, and there's no parole in the federal system, so he'll be in there for 13+ years at least

The judge went beyond what the prosecutors were seeking.
edit: Evidently, the sentence allows him to appeal. He waived the right to appeal if the sentence was 12.5 years or less (which is what the prosecutors were seeking).

Federal sentencings are advised by a table that accounts for your criminal history and the gravity of your crime: http://www.ussc.gov/sites/default/fi...cing_Table.pdf
Making it really simple: your "offense level" is controlled by things like the amount of images you have, whether they show sadistic conduct, etc. etc. etc. The range is one that is (again simplifying) presumed reasonable, but judges are, with reasons, allowed to vary upwardly or downwardly from that range. I bore you with all of this because, as you can see, 188 months is a relevant number. It represents the top or bottom of several ranges. Which makes it very likely that the Judge gave him the top or bottom of the advised range for his crime--finding him no more or less culpable than the average defendant on his facts. |

Calculating that number is a huge part of federal sentencing. It is a multi-factor analysis: Guidelines Manual | United States Sentencing Commission |

Ultimately, I think instead of blaming Subway subs for his crimes, Jared should have claimed dyslexia. After all, most media reports on the ages of his prey seem to indicate he rarely strayed from the guideline of one seventh his age plus two years.

His appeal to have his sentence reduced was rejected.
