Look at Thomas' post-9/11 rulings - he's become a big fan of giving the Executive more powers. In fact, in one of the Guantanamo rulings (Hamdi or Hamdan, can't remember), he was the only one of the 9 to agree with the Bush Administration's expansion of power.
